
MUSEUM IMMUNITY – ATTEMPT TO EVALUATE THE REGULATION 18 MONTHS AFTER IT CAME INTO FORCE

The article attempts to evaluate the introductionof legal security of historic, artistic or scientific movablesloaned from abroad for temporary exhibitions organisedin Poland (the so-called museum immunity); the regulationcame into force on 30 November 2015 as the new addendum4a to the Act on Museums.The author presents the rules which govern the new legalinstitution and, from a perspective of one year’s operation,presents their evaluation with regard to the achievementof the goals set and their legislative precision, includingsuggestions of changes.He observes that as far as the terms of protection areconcerned, the regulation copies the solutions proposed bythe Expert Team of the National Institute for Museums andPublic Collections which prepared a report on museum immunityin 2012, it introduces different solutions in terms ofprocedures for granting protection.In his conclusion, the author emphasises that the new regulationincludes many doubtful provisions, including thoseon the key issue of the moment when the protection ceases
