The article deals with the issues related to the study of the content of the function of judicial control at the stage of pre-trial investigation. Pre-trial investigation, as a structural part of the criminal justice system, has never been completely independent of its judicial stages. The court has always had ample opportunities to influence the quality of the preliminary investigation and inquiry. Judicial control is most clearly manifested in criminal proceedings. This is due to the fact that criminal law and criminal procedure relations directly affect the rights, freedoms and legitimate interests of a person and a citizen, protected at the highest level-by the norms of the Constitution of the Republic of Kazakhstan. This circumstance requires a particularly balanced approach to the development of new and improvement of existing norms in the industry law
