O fenômeno da positivação do culturalismo no código civil de 2002

Analisa o fenômeno da positivação do Culturalismo presente no Código Civil brasileiro de 2002, considerando o estudo do Direito, dos valores, da cultura e do culturalismo na obra de Miguel Reale. Apresenta estudos propedêuticos sobre a teoria do conhecimento, do conhecimento sobre os valores e sua importância para o conhecer do regime jurídico-privado construído para ser a fonte da interpretação jurídica. O esclarecimento sobre as mudanças é importante instrumento para enfrentar os desafios contemporâneos no plano das relações intersubjetivas tuteladas pelo Direito, em uma sociedade de acelerado desenvolvimento.It analyzes the phenomenon of positivation of Culturalism in the Civil Code of 2002, through the study of Law, values, culture and Miguel Reale’s though about culturalism. It presents introductory studies about the theory of the knowledge, the knowledge on the values and its importance to know the legal-private regimen constructed to be the source of the legal interpretation. The clarification on the changes is important instrument to face the challenges contemporaries in the plan of the intersubjetivas relations tutored by the Rights, in a society of sped up development
