The purpose of this article is to reflect on the implementation of a military justice in Brazil, focusing on its main organ, the Supreme Council of Military Justice. The article supports the hypothesis that this implementation was inspired by debates and political experiences that took place in Portugal under d. Maria I. Thus, the creation of the Supreme Council in 1808, and of other organs of the military justice afterwards, contributed to the internalization of an Ancien Régime juridical culture in Rio de Janeiro. In spite of all the criticism that was directed to it throughout the XIX century, this juridical culture will endure without significant changes until the Proclamation of the Republic in 1889
