A Emenda Constitucional n.º 45/2004 e a nova competência da Justiça do Trabalho

When you mention the jurisdiction of the Labor Court is endorsing the power that the adjudicative body has to exercise jurisdiction to adjudicate the made according to their assignments. With Constitutional Amendment nº 45/04 the jurisdiction of the labor courts underwent significant expansion. With this modification, several matters before subject to ordinary jurisdiction, were incorporated by this specialized court. With this constitutional amendment,new material jurisdiction now covers litigations arising not only the employment relationship , but also those from the employment relationship. This fact has generated many questions about some specific situations within the Brazilian legal reality and deserves further study.Quando se menciona a competência da Justiça do Trabalho está-se referendando opoder que o órgão judicante tem de exercer jurisdição para processar e julgar osfeitos segundo suas atribuições. Com a Emenda Constitucional nº 45/04 acompetência da Justiça do Trabalho sofreu significativa ampliação. Com estamodificação, diversas matérias, antes sujeitas à jurisdição comum, foramincorporadas por essa Justiça especializada.
