Normativa sobre la ficha clínica y la protección de datos de salud en Chile

Este trabajo intenta explicar los aspectos que dan forma al estado actual de la regulación sobre las fichas clínicas. La exposición ha sido dividida en tres partes. La primera trata la relación entre la ficha, derecho a la privacidad y protección de la información. La segunda parte reorganiza las normas legales, reglamentarias y técnicas y las presenta sobre los tópicos estimados como relevantes. Finalmente, la tercera contiene una breve exposición sobre ciertos atributos a considerar sobre la regulación, los cuales ilustran el modo de comprender los conflictos que subyacen o que pudieran suscitarse entre la confidencialidad y otros derechos o intereses.This paper attempts to explain the aspects that shape the current state of the regulation on the medical record. It has been divided into three parts. The first is the relationship between the record, the right to privacy and data protection. The second part reorganizes the laws, regulations and technical standards, and presents them on the topics estimated as relevant. Finally, the third contains a brief discussion of certain attributes to consider about regulation, which illustrate how to understand the underlying conflicts or those conflicts that may arise between confidentiality and other rights or interests
