RESUMO:Bolívia enfrenta o desafio de construir um Estado Plurinacional conforme as bases assentadas pela recente Constituição de 2009. Dispositivo chave para esse propósito poderá ser o Tribunal Constitucional Plurinacional, pois constitui a única jurisdição interna que se situa tanto sob o sistema de justiça do Estado como do sistema de justiça indígena. É uma disposição constitucional sem precedente no âmbito latino-americano. Estas páginas partem de uma revisão na jurisprudência constitucio­nal dos Estados latino-americanos para ver se é possível encontrar orientações. Somente na Colômbia encontra-se algum elemento relevante da prática jurisdicional que pode ajudar em algo. Para todo o resto de opções plausíveis, o Tribunal Constitucio­nal Plurinacional da Bolívia enfrenta um desafio realmente inédito. ABSTRACT:Bolivia faces the challenge of building up a Plurinational State in accordance with the rules established by her brand new 2009 Constitution. For this purpose, the Plurina­tional Constitutional Court may become a key device since it is the only domestic juris­dictional body placed upon both the state judicial system and the judicial system of indi­genous peoples. Such a constitutional approach is unique in the Latin American region. This paper reviews the constitutional jurisprudence among Latin American States in search of possible guidelines. Only Colombia offers a significant piece of jurisdictional practice that may lend a hand in this regard. As for the rest of feasible options, the Pluri­national Constitutional Court of Bolivia actually faces an unprecedented challenge.
