Penyelesaian Sengketa Tanah Melalui Mediasi: Studi Kantor Pertanahan Kabupaten Bantaeng

Tujuan penelitian ini adalah: 1) Untuk mengetahui dan menganalisis penyelesaian sengketa tanah melalui mediasi di Kantor Pertanahan Kabupaten Bantaeng; dan 2) Untuk mengetahui dan menganalisis faktor-faktor yang mempengaruhi penyelesaian sengketa tanah melalui mediasi di Kantor Pertanahan Kabupaten Bantaeng. Penelitian ini adalah penelitian deskriptif dengan pendekatan yuridis-empiris atau pendekatan tipe normatif dan empiris. Hasil penelitian menunjukkan bahwa: (1) Penyelesaian sengketa tanah melalui mediasi di Kantor Pertanahan Kabupaten Bantaeng terlaksana kurang efektif, termasuk: (a) Tahap pra mediasi termasuk kegiatan persiapan pertemuan para pihak dan kegiatan pengundangan para pihak; (b) Tahap mediasi meliputi: kegiatan mediasi, kegiatan penetapan agenda musyawarah, kegiatan identifikasi kepentingan, kegiatan generalisasi opsi para pihak, kegiatan penentuan opsi yang dipilih, kegiatan negosiasi akhir, dan kegiatan formalisasi kesepakatan penyelesaian sengketa.; dan (c) tahap pasca mediasi termasuk penerbitan dan penandatanganan sertifikat tanah para pihak; dan (2) Faktor-faktor yang mempengaruhi penyelesaian sengketa tanah melalui mediasi di Kantor Pertanahan Kabupaten Bantaeng, yaitu: substansi hukum, struktur hukum, budaya hukum, serta sarana dan prasarana.
The objectives of this study are: 1) To study and analyze land disputes through mediation at the Bantaeng District Land Office; and 2) To find out and analyze the factors that influence the resolution of land disputes through mediation at the Bantaeng District Land Office. This research is a descriptive study using juridical-empirical or using normative and empirical types. The results showed that: (1) Settlement of land disputes through mediation at the Bantaeng Regency Land Office was less effective, including: (a) The pre-mediation stage included preparatory activities for stakeholder meetings and stakeholder invitations; (b) The mediation phase includes: mediation activities, deliberation agenda setting activities, interest approval activities, activities of generalizing the parties' options, selection of selected options, final negotiation activities, and formalization of agreements for settlement agreements; and (c) and (2) Factors affecting land disputes through mediation at the Bantaeng District Land Office, namely: legal substance, legal structure, legal culture, and facilities and infrastructure.
