A PROPÓSITO DEL ESTADO DE ALARMA DECRETADO EN ESPAÑA POR CAUSA DEL COVID-19: EL OLVIDO DEL PRINCIPIO DE PROPORCIONALIDAD

En el presente trabajo efectuaremos un análisis de la regulación del estado de alarma (requisitos y procedimiento para su adopción), poniéndolo en relación con las exigencias que dimanan del principio de proporcionalidad, integrado por los subprincipios de necesidad, idoneidad y proporcionalidad en sentido estricto y, ello, con la concreta pretensión de colegir si la declaración en España, en 2020, de los Estados de alarma con motivo del Coronavirus, así como las medidas adoptadas con la propia declaración y ulterior transcurso del mismo pueden plantear problemas de licitud y generar, por extensión, problemas, en especial desde el punto de vista de la responsabilidad del Gobierno en un futuro próximo. Azken batean, gure asmo zehatza hauxe da: jakitea ea Coronavirusa dela-eta 2020an Espainian deklaratu zen alarma-egoerak berak eta deklarazio horrekin batera eta alarma-egoerak aurrera egin ahala hartu diren neurriek zilegitasun-arazorik eragin dezaketen eta, bide batez, etorkizun hurbilean bestelako arazorik ekar dezaketen batez ere gobernuaren erantzukizunari dagokionez. The main objective of this study is to analyze the regulation of the State of Alarm (requirements and procedure for its adoption), by relating it to the demands arising from the principle of proportionality, made up of the sub-principles of necessity, suitability and proportionality in the strict sense and, this, for the purpose of determining whether the declaration in Spain, in 2020, of the State of alarm on the occasion of the Coronavirus, as well as the measures adopted with the declaration itself and its subsequent course, may pose doubts of legality and generate, by extension, problems, especially from the point of view of the responsibility of the Government in the near future.
