Reflexos das alterações na LINDB: a busca pela alteridade na responsabilização do agente público

RESUMO:  As recentes alterações promovidas na Lei de Introdução às Normas de Direito Brasileiro – LINDB implicam, agora de forma positivada em texto normativo, na necessidade de se balizar o controle do ato administrativo, principalmente aqueles exarados no exercício da competência discricionária, sob o influxo de novos parâmetros técnicos e racionais. Grande parte da doutrina, e significativos arestos jurisprudenciais, já apontavam para a indispensabilidade da utilização do método da ponderação concomitantemente ao tradicional método da subsunção ou, em outras palavras, a substituição da típica relação jurídica causal pela análise consequencialista da aplicação normativa, com o dever de sopesamento da ordem objetiva dos valores constitucionalmente tutelados, buscando, ao fim, inserir mais alteridade ao controle do ato administrativo. PALAVRAS-CHAVES: nova LINDB, controle externo do ato administrativo, discricionariedade administrativa, método da ponderação, causalidade, consequencialismo, alteridade.     ABSTRACT: The recent changes introduced in the Introductory Law to the Brazilian Law System - LINDB imply, now in a positive way in normative text, the need to regulate the control of the administrative act, especially those noted in the exercise of discretionary jurisdiction, under the influence of new technical and rational parameters. Much of the doctrine, and significant jurisprudential arguments, already pointed to the indispensability of using the weighting  method concomitantly with the traditional method of subsumption or, in other words, the substitution of the typical causal legal relationship for the consequentialist analysis of normative application, with the duty of weighing the objective order of the constitutionally protected values, seeking, at the end, to insert more alterity to the control of the administrative act.
