On the issue of removing from a convicted person the status of a malicious violator of the established procedure of serving a sentence

В статье рассматриваются вопросы признания осужденного к лишению свободы злостным нарушителем установленного порядка отбывания наказания, а также снятия данного статуса. На основе анализа норм уголовно-исполнительного законодательства, результатов научных исследований делается вывод, что в настоящее время отсутствует процедура снятия либо погашения статуса злостного нарушителя режима. Рассматриваются возможные варианты устранения пробела в законодательстве. Предлагаются варианты сохранения данного статуса на весь период отбывания наказания, снятия одновременно с погашением и снятием взыскания, переводом из строгих условий отбывания наказания. Формулируются предложения по дополнению Уголовно-исполнительного кодекса Российской Федерации новой статьей The article discusses the issues of recognizing a person sentenced to imprisonment as a malicious violator of the established order of serving a sentence, as well as removing this status. On the basis of the analysis of the norms of the penal legislation the results of scientific researches it is concluded that at present there is no procedure for withdrawing or extinguishing the status of a malicious violator of the regime. Possible options for eliminating the gap in legislation are being considered. Options are proposed for maintaining this status for the entire period of serving the sentence, withdrawing simultaneously with repayment and lifting the penalty, transferring from the strict conditions of serving the sentence.
