
Revival the Science of Jurisprudence principles between originality and modernity: A comparative analytical study

This research discusses the renewal matters in the Islamic jurisprudence by scholars on its origin method. The team of the modern scholars have improved to give some new opinions about some matters in jurisprudence. The major difference among the both teams: one team wants to hold views of origin method and the other team who hold the modern way of understanding is that: the priority of first team to renew and reconstruct with respect the views of traditional scholars. In addition, they have tried to purify the matters from mistakes which does not have relationship with jurisprudence. So that they can simplify and make it easier for the reader. Meanwhile, the other team of the modern scholars have tried to renew the matters of jurisprudence irrespective views of traditional jurisprudence scholars without stick to their views. The main reason is time and place changes the jurisprudence. So that it is necessary to put the new bases for this subject.
