The 340B program gets its name from its location in Section 340B of the Public Health Service Act. The program was created in 1992 to provide mandatory discounts to certain government agencies and recognized nonprofits. Drug manufacturer participation in this program is mandatory for manufacturers that wish to have their products covered under the Medicaid program. Baldwin discusses the current controversy and pending legal decisions surrounding this program.
