O TRANSCONSTITUCIONALISMO E A CRISE DE EFICÁCIA, EFETIVIDADE E EFICIÊNCIA DA NORMA CONSTITUCIONAL TRANSVERSAL DO ESTADO SOCIAL

The "transconstitucionalismo" is a recent concept and in training, that means free and positive dialogue between independent constitutional orders to produce the reciprocal use of external rationalizations. In particular in the work of Marcelo Neves is a set of contemporary phenomena associated with transcontitucionalismo and involving a wide margin of possibilities of these dialogues. Here is proposing to say that the crisis of the welfare state puts in check these dialogues, by the resurgence of liberal constitutional law. The post-modernity dilutes the Constitutionalism in its structure attached to a sovereign State. New decision-making bodies undermine constitutional maturity of modernity. The constitutional transversality is questioned in efficiency, efficacy and effectiveness on the crisis of the welfare state. Then the initial hypothesis here is that the Constitution is threatened this function of transversality. But also discusses the alternative of emphasis on the efficiency of Justice and administration, with the purpose to overcome the crisis.O “transconstitucionalismo” é um conceito recente e em formação, que significa o diálogo livre e positivo entre ordens constitucionais independentes a produzir o aproveitamento recíproco de racionalizações externas. Em especial na obra de Marcelo Neves encontra-se um conjunto de fenômenos contemporâneos associados ao transcontitucionalismo e que implicam numa margem larga de possibilidades destes diálogos. Aqui se propõe afirmar que a crise do Estado Social põe em cheque estes diálogos, pelo recrudescimento do direito constitucional liberal. A pós-modernidade dilui o constitucionalismo na sua estrutura presa a um Estado soberano. Novas instâncias decisórias esvaziam a maturidade constitucional da modernidade. A transversalidade constitucional é questionada em eficiência, eficácia e efetividade diante da crise do Estado Social. Então a hipótese inicial aqui é que a Constituição é ameaçada nesta função de transversalidade. Mas também se discute a alternativa de ênfase à eficiência da justiça e daadministração, com fins a superar a crise
