In this article continues a critical analysis of the views existing in domestic legal science on the essence and limits of such a legal phenomenon as “criminal responsibility”, linking it with the criminal procedural institution of bringing a person as an accused. The author defends the thesis that criminal liability arises only as a result of an adversarial trial.
