
The concept and judicial protection of the right to insolation: comparative legal research

The concept and definition of the right to sunlight (the right to insolation) in Russia and in foreign countries are considered. A similar right is analyzed in Japan, referred to as «Nisshoken», and in the United Kingdom, known as «right to light». Attention is paid to the importance of sunlight for a person, in particular, the need for a person’s aesthetic experience is justified. The main normative legal acts of Russia and a number of foreign countries in the field of realization of the right to sunlight are studied. Ways to protect the right to sunlight are illustrated, and examples from the judicial practice of Russia, Japan, and the United Kingdom are given.
