In the article, through the prism of the effectiveness of the ratio, the development of some courses of criminal policy in the areas of development of the institution of crime is demonstrated, in the context of determining the categories of acts by the nature and degree of public danger, as well as the possibility of reducing them by one level, taking into account the conditions specified in part 6 of article 15 of the Criminal code of the Russian Federation; uncertainties in the legal meaning and content of the signs of a state of intoxication, reflected in article 23, part 11 of article 63 and article 264 of the Criminal code of the Russian Federation; development of directions of exemption from criminal liability on the example of part 1 of article 761 of the Criminal code of the Russian Federation and notes to articles 198 and 199 of the Criminal code of the Russian Federation.
