We consider the position of the legislator and the theoretical views of scientists on the «category» of punishment. The essence of criminal punishment and problematic issues in the understanding of its legal are revealed. The author evaluates scientific developments, principles, applies laws and methods of the humanities and social sciences to solve the problem of determining the concept of punishment.
