This article aims to perform a critical analysis of four controversial decisions issued by the Brazilian Regional Court of the 5th Region, which deal with public outsourcing by cooperatives, pointing out the legality and the reasons for its use, also dealing with myths and truths, doctrine, overviews and paradoxical understandings.
The combined analysis of these elements necessarily goes through fraud in the labor relations, without evading the public interest that surrounds the matter, confronting them with the legislation, jurisprudence and precedents, thus making it possible to obtain a critical look at the topic.
