The article reveals the content of the concept of imaginary competition and its negative impact on real competition. The formal normative approach to the interpretation of the constitutional ban on monopolization and monopolistic activity is criticized. The necessity of legislative consolidation of prohibition (prohibitions) on imaginary competition form (forms) of monopolistic activity is substantiated.
