In the article, the author comes to the conclusion that kidnapping is characterized by the unlawful seizure of a person, his displacement and subsequent retention against or against his will. Capturing, moving and restraining a person can be carried out both by deception or abuse of the victim's confidence, and with the use of violence or the threat of violence, or without it. The fact that the guilty persons do not have a goal of further restraining the victim indicates the absence of corpus delicti of kidnapping, while the presence of other corpus delicti in the actions of the guilty parties is not excluded.
