AbstrakPenelitian ini mengkaji permasalahan mengenai politik hukum pemerintah dalam penanganan pandemi corona (COVID 19) ditinjau dari perlindungan Hak Asasi atas Kesehatan. Hak Asasi atas kesehatan merupakan salah satu derivasi dari Hak Asasi Manusia yang harus dilindungi dan dipenuhi termasuk dari ancaman pandemi COVID-19. Dalam penanganan pandemic COVID 19 Pemerintah telah menerbitkan beberapa Produk Hukum seperti Peraturan Pemerintah Pengganti Undang-Undang (PERPPU) Nomor 1 Tahun 2020 dan Peraturan Pemerintah Nomor 21 Tahun 2020 tentang PSBB. Pemerintah juga menerapkan kebijakan PSBB dan Physical Distancing, akan tetapi kebijakan tersebut tidak efektif memutus rantai penyebaran COVID-19 terlihat dari jumlah kasus COVID 19 di Indonesia tertanggal 28 Januari 2021 sudah tembuh 1 juta kasus, tertinggi di Asia Tenggara. Jenis penelitian ini adalah penelitian yuridis normative yang bersifat perskriptif dengan maksud memberikan solusi terhadap penanganan COVID-19 di Indonesia. Penelitian ini menyimpulkan bahwa Politik Hukum yang dipilih Pemerintah Indonesia berupa PSBB dan physical distancing dalam penanganan COVID-19 tidak maksimal dalam melindungi hak atas kesehatan masyarakat Indonesia sebagaimana amanat konstitusi Pasal 28 H ayat (1) dan Pasal 34 ayat (2) serta (3) UUD NKRI Tahun 1945. Seharusnya Pemerintah menerapkan kebijakan lock down parsial sebagaimana keberhasilan china melakukan lock down parsial di Wuhan, Provinsi Hubei. Dengan lock down parsial di Provinsi Jakarta sebagai epicentrum pandemic COVID-19 di Indonesia maka virus tersebut tidak akan menyebar ke provinsi lain AbstractThis research studies issue regarding government legal politics in dealing with the corona outbreak (COVID 19) reviewed from the right to health. The right to health is one of the derivations of human rights that must be protected and fulfilled, including from the threat of COVID-19. The Government has issued several legal products in handling COVID 19 pandemic,  such as Government Regulations in lieu of Law Number 1 of 2020 and Government Regulation Number 21 of 2020 concerning PSBB. the Government also implemented the PSBB and Physical Distancing policies, however, these policies were not effective in breaking the spread of COVID-19 as seen from the number of COVID-19 cases in Indonesia dated January 28, 2021, which has reached 1 million cases, the highest in Southeast Asia. This type of research is a normative juridical research that is perscriptive to provide solutions to handle The COVID-19 in Indonesia. This research concludes that the Legal Policy chosen by the Indonesian Government couldn’t protect the right to health of the Indonesian people as mandated by The Article 28 H paragraph (1) and Article 34 paragraph (2) and (3) UUD 1945. The government should have implemented a partial lock down policy as China's success in doing it in Wuhan, Hubei Province. With a partial lock down in Jakarta Province as the epicenter of the COVID-19 pandemic in Indonesia, the virus will not spread to other provinces
