The trust is an important, often unappreciated. business instrument. Several of the various commercial applications of the trust are reviewed in the first part of this article. The author then focuses on some of the considerations involved in employing the trust as an alternative form of business organization. Special attention is given to requirement of trustee autonomy and the office of "protector."
