Through a comparative study of twocourt decisions, this article presents a linguisticanalysis of the applicable rules toasylum applicants in France. First, theauthor underlines the importance of theliterary style in the drafting of decisionson the merits. Second, she analyzes the"language of the law" to show how thestructure of legal thought sometimes differs from formal logic andcommon sense,thus justifying legal decisions taken withregard to asylum applicants that couldnot be rationally justified.
