La Convención internacional sobre los derechos del niño resulta ambigua. Reconoce los derechos del niño, pero al margen del ámbito natural donde deben situarse: la familia. La ambigüedad corre paralela a la desestructuración de la familia que está teniendo lugar, en la práctica y en la teoría, en los últimos siglos. El artículo analiza los fundamentos de la familia en la historia de Occidente y las causas más notables de la indefinición a la que ahora asistimos.The Convention on the rights of the child is ambiguous. It recognises the rights of the child, but away from the natural environment where they should be placed: the family. This ambiguity goes along the de-structuring of the family that has been taking place, in theory and in practice, in the last few centuries. The article analyses the bases of the family in the history of the Western culture and the most notable causes for the lack of definition we now observe.
