Abstrak Penelitian ini bertujuan untuk mengetahui bagaimana pemenuhan hak-hak orang gila dalam HAM dan Hukum Islam. Adapun pokok permasalahan dijabarkan dalam tiga sub masalah, yaitu 1) Bagaimana kategori orang gila dalam Hukum Islam 2) Bagaimana perlindungan hak-hak orang gila dalam HAM 3)  Studi komparasi HAM dan Hukum Islam terhadap pemenuhan hak-hak orang gila. Berdasarkan penelitian ini, diperoleh beberapa hasil yaitu kurangnya perhatian terhadap orang gila sehingga sangat sulit bagi dirinya untuk mendapatkan haknya sebagai manusia meskipun dalam HAM dan Hukum Islam orang gila masih memiliki hak-hak yang harus dipenuhi. Dengan adanya penerapan hak orang gila, maka akan lebih mudah bagi dirinya dalam mendapatkan hak-haknya serta diharapkan kepada masyarakat agar stigma buruk terhadap orang gila perlahan berubah dan  mulai menyadari hak orang gila sebagai manusia yang harus dihormati. Kata Kunci : Orang Gila; HAM; Hukum Islam.Abstract This study aims to find out how to fulfill the rights of crazy people in human rights and Islamic law.  The main problem is described in three sub-problems, namely 1) How is the category of crazy people in Islamic Law 2) How is the protection of the rights of crazy people in human rights 3) Comparative study of Human Rights and Islamic Law on the fulfillment of the rights of crazy people Based on this research, several results are obtained, namely the lack of attention to crazy people so that it is very difficult for him to get his rights as a human being even though in human rights and Islamic law crazy people still have rights that must be fulfilled. With the application of the rights of crazy people, it will be easier for him to get his rights and is expected to the public so that the bad stigma against crazy people slowly changes and begins to realize the rights of crazy people as human beings who must be respected.Keywords: Crazy People; Human Rights; Islamic law
