AbstrakPenelitian ini membahas prinsip equality before the law yaitu menghendaki tidak ada warga negara yang mendapat pengistimewaan dalam bidang peradilan. Bertitik tolak pada TAP MPR Nomor 7 tahun 2000 Tentang pemisahan Tentara Nasional Indonesia dan Kepolisian Negara Republik Indonesia yang dimana mengamanatkan bahwa anggota militer yang melakukan tindak pidana umum diadili pada badan peradilan umum, yang dimana berbeda dengan yuridiksi Pengadilan Militer Undang-Undang Nomor 31 tahun 1997 yang mengamanatkan bahwa anggota militer yang melakukan tindak pidana umum diadili di Pengadilan Militer. Serta pengadilan militer merupakan badan peradilan yang memberikan keistimewaan kepada anggota militer. Penelitian ini mengkaji tentang bagaimana penerapan asas Equality Before The Law Pada Sistem Peradilan Militer di pengadilan militer III-16 Makassar, penelitian ini menggunakan metode kualitatif dengan pendekatan yang dilakukan adalah Yuridis dan Sosiologi dengan sumber data dari Peradilan Militer III-16 Makassar. Selanjutnya metode pengumpulan data yang dilakukan adalah wawancara, observasi, dokumentasi dan penelusuran referensi. Kemudian teknik pengolahan data dilakukan melalui beberapa tahapan yakni: reduksi data, penyajian data, dan penarikan kesimpulan. Penelitian ini memberikan hasil bahwa tidak ada tindakan pengistimewaan prajurit militer yang melakukan tindak pidana dalam sistem pengadilan militer, dan tidak ada perbedaan dalam penanganan perkara tindak pidana umum di pengadilan militer dengan pengadilan umum.Kata Kunci: Equality before the Law, Pengadilan Militer, Prajurit, Pidana.AbstractThis study discusses the principle of equality before the law, namely requiring that no citizen be privileged in the field of justice. Starting from the MPR Decree Number 7 of 2000 concerning the separation of the Indonesian National Army and the Indonesian National Police, which mandates that members of the military who commit general crimes be tried in a general judicial body, which is different from the jurisdiction of the Military Court Law Number 31 of 1997 which mandated that members of the military who committed general crimes be tried in a military court. As well as military courts are judicial bodies that give privileges to members of the military. This study examines how the application of the principle of equality before the law in the Military Court System in the military court III-16 Makassar, this research uses qualitative methods with the approach taken is juridical and sociological with data sources from the Military Court III-16 Makassar. Furthermore, the data collection methods used are interviews, observation, documentation and reference tracing. Then the data processing technique is carried out through several stages, namely: data reduction, data presentation, and drawing conclusions. This study provides the results that there are no privileged acts of military servicemen who commit crimes in the military court system, and there is no difference in the handling of general criminal cases in military courts and general courts.Keywords: Equality before the law, Military Court, Soldiers, Criminal.
