PERSPECTIVAS PARA O ENSINO DE ‘CIBERDIREITO’ A PARTIR DAS NOVAS DIRETRIZES CURRICULARES PARA OS CURSOS DE DIREITO NO BRASIL

RESUMOO presente texto tem por objetivo apresentar o “ciberdireito” como uma nova disciplina jurídica capaz de contemplar os elementos trazidos pelas novas diretrizes curriculares para os cursos de Direito no Brasil, analisando as transformações socioculturais e jurídicas que o uso massivo da internet está promovendo. Nesse sentido, é necessário que os futuros e atuais atores do mundo jurídico apresentem o mínimo de domínio acerca das práticas das novas tecnologias e como seus resultados afetam a esfera jurídica, para que seja possível evitar que processos e procedimentos cotidianos sejam fadados à ineficiência jurisdicional e a total ineficácia dos direitos tutelados. PALAVRAS-CHAVE: Ciberdireito; Novas tecnologias; Democracia; Novas Diretrizes Curriculares do Direito. ABSTRACTThis text aims to present the "cyberlaw" as a new legal discipline capable of contemplating the elements brought by the new curricular guidelines for Law courses in Brazil, analyzing the socio-cultural and legal transformations that the massive use of internet is promoting. In this sense, it is necessary that future and current actors in the legal world have a minimum of mastery over the practices of new technologies and how its results affect the legal sphere, so that it’s possible to avoid that day-to-day processes and procedures are doomed to jurisdictional inefficiency and the total ineffectiveness of the protected rights.
