دور المقاصد الشرعية في تنزيل الفتوى مع مراعاته لتغير الزمان والمكان والعادات

الملخص إن دور المقاصد الشرعية في تنزيل الفتوى والأØكام مع مراعاته لتغير الزمان والمكان والعادات تقتضي Øاجة ضرورية للمفتي Ø§Ù„ØªØ³Ù„Ø Ø¨Ù‡Ø§ لمعرفة التغييرات الطارئة في العصر الØاضر والوصول لقيمة الفتوى، وأن بنائها يعتمد على الاختلاف في الأزمنة والأمكنة والأØوال -مع الØرص على تØقيق مقاصد الشريعة-  Ø§Ù„ذي يقتضي تغير الفتوى بناء على التغير الØادث من ذلك الاختلاف. ويتناول إشكالية الدراسة عن دور الفقيه في الالتزام بتØقيق مقاصد الشريعة في الفتوى مع مراعاته لتغير الزمان والمكان، والأدوات الفقهية التي ÙŠØتاج المفتي مراعاته لتأسيس الفتوى وتنزيله في الواقع. والهدف من الدراسة تفعيل دور المقاصد الشرعية والقواعد الفقهية في الاستدلال على بعض المسائل والتطبيقات، ومعرفة دور القاعدة الفقهية "في تغير الفتوى واختلافها بØسب تغير الأزمنة والأمكنة والأØوال والنيات والعادات". واعتمدت الدراسة على منهج المكتبي الإستقرائي القائم على مطالعة الكتب والبØØ« وجمع المعلومات. ومناقشة الأقوال وتØليلها. واستخلصت الدراسة الى إن تغير الفتوى واختلافها بØسب تغير الأزمنة والأمكنة والأØوال والنيات والعادات تمثل أثرا بالغ الأهمية في تنزيل الفتوى عن علم وتبين، وأن العناية بالتقعيدين الأصولي والمقاصدي عند إصدار الفتوى له فوائد عظيمة في فهم النصوص الشرعية وتفسيرها وَفق Ø§Ù„Ù…ØµØ§Ù„Ø Ø§Ù„ØªÙŠ جاءت بها هذه النصوص، ورعاية تغير الأزمنة والأمكنة وعدم الجمود على المسطور يمثّل أقوم اجتهاد. Abstract It was observed that the change of rules and regulations based on customs and social habits has an impact on the formation of scholarly religious opinion. Furthermore, there is also a difference of the custom value in both the religious context and the contemporary scholarly thought. Therefore, there is a need to reconsider and reinvestigate the old thought and renew them according on changes in the contemporary social costumes and habits. This paper is on a religious scholarly rule entitled, the change of the religious scholarly opinion based on changes of place, time, intentions and social costumes’. The aim of this study is knowing the impact of customs and social habits change in contemporary thought on the application of the Islamic rules and resolving the controversy of these costumes concordance with the Islamic scholarly rules. This study is a qualitative one as it implements a content analysis methodology to analyze data. It compared scholarly views and discussed them to resolve the controversy of the concordance of the changing customs and social habits with the Islamic scholarly rules and views. The study found out that the Islamic scholarly rule ‘Changes of rules based on the change of customs, habits, situations, place and time’ has a serious impact on interpreting the Islamic texts. It was found out that the Islamic scholars interpret the Islamic text based on the views that reflect contemporary conditions of the place and time and social costumes and habits.  the Study recommended that such interpretation should be monitored by the fixed Islamic text that allow considering the contemporary social costumes and habits without distorting and going beyond the fixed Islamic text.  Keywords: al-CÄ€dah al-Muhakkamah, customs, change of rules
