Neste artigo, pretende-se, através da distinção entre direitos humanos e direitos fundamentais, explicitar o caráter pré- e supraestatal dos direitos humanos. A partir dessa distinção, buscaremos imunizar o discurso sobre os direitos humanos contra a objeção de que se trata de um discurso etnocêntrico ou ilegítimo, para enfim concluirmos que com sua efetividade poderemos chegar, como queria Kant, à paz perpétua ou a uma República mundial.Abstract: In this article, it is intended, through the distinction between human rights and fundamental rights, to show the pre- and supra state character of the human rights. Starting from that distinction, we will try to immunize the speech on the human rights against the objection that it is an ethnocentric or illegitimate speech, for, finally, we conclude that with its effectiveness we could arrive, as Kant wanted us, to the perpetual peace or a world Republic.
