Resumen: El Auto de la Audiencia Provincial de Toledo de 7 de marzo de 2018 resuelve dos cuestiones relativas (1) a los requisitos para que una sentencia de divorcio obtenida en Marruecos tenga el efecto de res iudicata en España y (2) a la competencia judicial internacional de los tribunales españoles para conocer del divorcio. El autor del comentario discrepa del razonamiento utilizado por la Sala, al omitir la aplicación al caso del Convenio hispano-marroquí de 30 de mayo de 1997 y del Reglamento (UE) núm. 2201/2003, de 27 de noviembre (RB II-bis).Palabras clave: Res Iudicata, divorcio internacional, Convenio hispano-marroquí de 30 de mayo de 1997, Reglamento (UE) núm. 2201/2003 (RB II-bis).Abstract: The judgment rended by the Provincial Court of Toledo of March 7, 2018 resolves two questions regarding (1) the requirements of a divorce judgment obtained in Morocco to having the effect of res iudicata in Spain and (2) the jurisdiction of Spanish courts to hear the divorce case.
