
The functioning practice of the National Centre for the Prevention of Antisocial Behaviour. Comments on the Constitutional Court judgement dated on 23 November 2016 in case no. K 6/14 — part I

This text analyses selected current problems connected to the functioning of the National Centre for the Prevention of Antisocial Behaviour in Gostynin, established at the beginning of 2014 on the basis of the Act of 22 November 2013. The point of reference for author’s deliberations is the Polish Constitutional Court judgment (case no. K 6/14), which stated that the act, apart from one article, is consistent with the Polish Constitution. Author, from the perspective of over seven years of application of the law and in relation to the court's arguments, analyses problems concerning the subjective scope of the act, therapeutic methodology, and living conditions in the aforementioned National Centre. The following text is the first part of a comprehensive material discurssing the problem of post-penal isolation whose continuation will be published in the next issue of the journal. It leads to the conslusion that the introduced regulation is ineffective and contrary to the standards of protection of human freedoms and rights.
