This article discusses the current judicial practices considering ways to protect the creditors rights to choose an arbitration manager at different stages of bankruptcy proceedings. The author draws attention to the possibility of a transfer of the right to choose an arbitration manager from the first claimant to its assignee. In addition, the article contains an overview of procedural means of preventing from approving the biased candidate of an arbitration manager.
