The article is devoted to the issues of recognizing the inadmissibility of evidence when considering a criminal case by a jury. It points to a violation of the adversarial principle and proposes an algorithm for resolving issues of this kind that are not resolved in the preliminary hearing and are resolved at the stage of the judicial investigation.
