The article reviews the issues related to the definition of smuggling as a completed crime and a criminal attempt, liability for which is stipulated by articles 200¹, 200², 226¹ and 229¹ of the Criminal Code of the Russian Federation, taking into account the clarifications of the resolution of the Plenum of the Supreme Court of the Russian Federation dated April 27, 2017 No. 12 On Judicial Practice in Smuggling Cases. The author singles out the peculiarities of definition of smuggling at illicit transfer of smuggled items across the customs border of the Customs Union within the EAEC (EAEU customs border) and the state border of the Russian Federation with the Customs Union member states within the EAEC (EAEU member states), at import and export of the smuggled items to and from the EAEU customs territory.
