The aim of this study is to present the issues of a professional confidentiality of a notary on the background of pending criminal proceedings, the scope of the subject of discretion, the reasons for exempting a notary from the obligation to maintain professional secrecy in a criminal trial, as well as emphasizing the protection of a notarial secrecy in the case of securing documents for the purposes of a criminal trial. Issues related to a notarial secrecy were discussed both from the perspective of the notary public acting as a witness and the accused. Criminal proceedings issues present in the Polish notary’s office are still not a widely discussed issue, which is why such a topic is worth analyzing.
