Resumo: Com o objetivo de analisar as alterações trazidas pela Lei nº 12.015/09, especificamente em relação ao delito de estupro, a presente pesquisa discute a possibilidade de aborto a pedido do homem na hipótese de figurar como sujeito passivo do delito. A finalidade precípua da lei foi assegurar maior efetividade e proteção na aplicação do princípio da dignidade da pessoa humana frente à violação da intimidade sexual do ser humano, de modo a respeitar a dignidade sexual de todos. Portanto, dentro das alterações relativas ao crime de estupro, analisaram-se as figuras do sujeito ativo e passivo, com um olhar na participação da mulher como autora da modalidade criminosa. Assim, por meio da pesquisa jurídica de vertente jurídico-dogmático, do raciocínio dedutivo de caráter interdisciplinar, através da investigação hermenêutica ou interpretativa, utilizado o método teórico ou bibliográfico, verificaram-se as possibilidades de restrições do direito fundamental à vida do nascituro, especificamente no que tange ao pedido de aborto feito pelo homem, pelo qual se utilizou da teoria de ponderação dos princípios de Robert Alex diante a colisão de interesses de terceiros frente ao caso concreto para sustentar a legitimidade da intervenção.Abstract: In order to analyze the changes introduced by Law nº 12,015 / 09, specifically in relation to the offense of rape, this research discusses the possibility of abortion on demand in the event of man appear as the subject offense liabilities.
