
ON THE QUESTION OF SOME LEGAL POWERS OF THE PROSECUTOR IN THE STAGE OF INITIATION OF A CRIMINAL CASE IN CRIMINAL CASES CONDUCTED BY INQUIRY BODIES

The article examines the issues of the implementation of certain legal powers by the prosecutor relatedto the implementation of prosecutorial supervision at the stage of initiation of a criminal case. The authorcomes to the following conclusions. Firstly, the stage of initiation of a criminal case is an independent partof criminal proceedings acting as a guarantor of the stable functioning of the criminal procedural system asa whole and the criminal procedural mechanism for considering reports of a crime which provide a quickresponse to information containing data the obligation to accept it register and verify it make a legal andwell-grounded decision observe the constitutionally guaranteed rights and freedoms of citizens. Secondly,the prosecutor when exercising supervision over the bodies of inquiry at the stage of initiating a criminalcase has a sufficient scope of powers. However in order to increase the effectiveness of criminal proceedingsit is necessary to allow the prosecutor to initiate criminal cases under investigation by the inquiry bodieswith their further transfer for investigation.
