The consent for the discharge of effluent is a contract between the discharger and the regulator. Its purpose is reviewed and compared with effluent performance characteristics. The evolvement of consent conditions and compliance assessment in Scotland is described, together with the challenge posed by the need to implement the urban waste water treatment Directive. A new framework for the consent contract is proposed for sewage and industrial discharges, which clearly prescribes the required effluent performance, authorizes non‐compliance, and embodies an explicit assessment of compliance.
