Actions by employers against their professional advisers are on the increase. With the recent changes in the water industry it is possible that the trend will continue, if only because the new private owners can be expected to be less tolerant than their predecessors. This development is compounded by the complicated technical progress with which water engineers are required to be familiar in an industry which demands skills of a high order. The paper reviews some of the situations in which professional liability can arise, with reference to appropriate case law. The present state of the law in this field is the product of accidental and haphazard development of litigation, with a period of great uncertainty having now become more settled by some recently decided cases.
