Motions to Dismiss are an everyday part of both the attorney and the judge’s legal life. The concept is relatively simple. A complaint or counter claim need to state clearly and with some precision what is being claimed. The “statement” sets the stage for the response, known as the “answer,” any defenses that are going to be asserted and lets all parties know what the underlying issues will be on this legal matter.
