This note analyses the House of Lords decision in Animal Defenders International v Secretary of State for Culture, Media and Sport . It argues that their Lordships' reasoning was premised on a narrow conception of ‘democracy as Parliament’ and seeks to challenge that view by suggesting the courts adopt a more participatory model of democracy.
