Innecesarias y restrictivas las modificaciones constitucionales en materia de libertad religiosa en México (Artículos 24 Y 40)

ResumenLas reformas a los artículos 24 y 40 de la Constitución se refieren al tema de la libertad religiosa en México y al carácter laico del Estado mexicano. Por lo que tiene que ver con la primera, el actual texto, ya aprobado, incorpora dos derechos más al artículo 24. Estos derechos son: el de libertad de convicciones éticas, y el derecho de libertad de conciencia. Por su parte, la redacción más reciente del artículo 40 constitucional, agrega la palabra laica para calificar a la República mexicana.El trabajo trata de hacer ver, a través de diez argumentos centrales, cómo ambas modificaciones constitucionales, en lugar de ampliar el espacio de protección de los derechos humanos de los mexicanos, o de precisar con mejor técnica legislativa los derechos ya existentes, abre la posibilidad para darle cualquier contenido a la expresión “libertad de convicciones éticas”, generando con esto una inseguridad jurídica que puede llegar a afectar el goce de los derechos humanos.AbstractThe amendments to Articles 24 and 40 of the Constitution refer to the issue of religious freedom in Mexico and the Mexican state’s secular character. So it has to do with the first, the current text, as approved, include two more rights in article 24. These rights are: freedom of ethical convictions, and the right to freedom of conscience. Meanwhile, the latest draft of article 40 of the Constitution, adds the word secular to qualify the Mexican Republic.The work try to show, through ten core arguments, as both constitutional amendments, rather than expanding the protection space of the human rights of Mexicans, or specify with better legislative technique the existing rights, opens the possibility to give any content to the term “freedom of ethical convictions”, thus generating legal uncertainty that may affect the enjoyment of human rights
