LAS CARACTERÍSTICAS JURÍDICAS DEL NEOLIBERALISMO

RESUMENEste artículo expone que los cambios sufridos en el mundo resultado de la nueva realidad neoliberal y globalizadora han producido una revolución jurídica que los ha acompañado y que ha reforzado el poder de las grandes potencias, corporaciones e instituciones supranacionales por encima de los intereses de los Estados-nación y de sus habitantes. El Estado y el derecho se han ido ajustando a esas transformaciones, y no necesariamente a favor de los derechos de los individuos que componen las sociedades respectivas, sino para apuntalar los intereses del nuevo capitalismo mundial.ABSTRACTThis article examines the changes that brought about around the world by neo-liberalism and globalization, which have spurred a legal revolution. These changes, in turn, have furthered strengthened already powerful nations, corporations, and supranational institutions far more than they empowered the interests of nation states and their populace. States and their legislation have adjusted to these transformations, while not necessarily adapting in favor of individuals, but rather by bolstering the newer interests of world capitalism
