The “school officials/legitimate educational interest” exception to disclosing education records without a student's written consent is one of the most frequently used of the §99.31 exceptions. To satisfy the Family Educational Rights and Privacy Act requirements to disclose education records under this exception, you must have (1) a “school official” who must have (2) a “legitimate educational interest” to have access to those records.
