A union prevention strategy list often has many checked boxes. Market‐based wages? Check. Competitive benefits? Check. Good employee morale? Check. Proactive communications? Check. An effective strategy is dynamic. Not only must it account for changes in existing checklist items, but it also must be ready to adapt to new workplace vulnerabilities that can create significant leverage for the organizing efforts of a union. Two recent cases drive home this point.
