Avoiding committing an unfair labor practice while communicating during a union campaign can be challenging. A few words can convert an otherwise lawful comment into a violation of the National Labor Relations Act. Social media, which memorializes such words and comments, can be a trap for the unwary—as seen recently in a ruling from the NLRB about a tweet from Tesla Inc. CEO Elon Musk ( Tesla, Inc ., 32‐CA‐197020 (2019)).
