In an era when unwelcome workplace comments and conduct are under increasingly intense scrutiny, the National Labor Relations Board has held onto a 40‐year‐old standard for determining whether profanity and similar offensive comments are protected under federal labor law. The standard may soon be changed, based on indications from the NLRB.
