The Eleventh U.S. Circuit Court of Appeals has upheld a unanimous National Labor Relations Board decision that Stainless USA violated a settlement agreement between the company and the Board. The agreement was intended to resolve a number of unfair labor practice (ULP) charges that had been made against the company during a union organizing drive. The company's violation was issuing its own so‐called side letter explaining the settlement.
