Recently, the National Labor Relations Board general counsel considered whether an employer's policy aimed at regulating employees' use of personal cell phones was lawful. Generally, the NLRB has taken the position that employees have a presumptive right, in most instances, to use personal phones during lunch breaks and other times when work is not required.
